In the past week, the people of Gaza have been subject to some serious Israeli attacks. Some Hamas leaders and militants have been murdered and many more Palestinians - innocent civilians, babies, kids women and elders – have lost their live. Yet, Gaza is celebrating with the Hamas leadership never more popular.

So here is an interesting anecdote that deserves our attention. During the recent clashes Gazan militants launched more than 1500 rockets at Israel. These rockets caused rather limited damage with more than six Israeli fatalities. Militarily at least, this is far from a great achievement. And yet the Gazans are celebrating. Would Israelis be happy to learn that 1500 of their rockets had had such limited effect? Would any western army accept such a result at such a cost? The answer is a categorical NO. But the Palestinians are ecstatic, why, because they know they have won the battle and are now set to win the war. They won the battle, not because they killed six Israelis – actually they would have won it without hitting one single Israeli. They won it because they managed to deliver a message to Israel, world Jewry and the whole world.

For many years I have argued that the Palestinian war of the rockets should be seen as sending a message: Israelis! You are on stolen land! You took our houses, villages, cities, fields and orchards. You pushed us into the desert. You surrounded us with barbed wire. You starve us and you kill us simply to suit your political ambitions. So this rocket is a message to you all. Think about us and then look at yourself in the mirror. Enough is enough!’

For more than six decades the Israelis have dismissed this message. They surrounded themselves with ghetto walls and have sealed their skies with an Iron Dome. However, with Tel Aviv now under attack, Israel and Israelis have been confronted with their original sin.

In the last two days, the entire Israeli media has admitted the colossal defeat of the so-called Operation Pillar of Cloud. Just yesterday, the Israeli right wing Ynet wrote “Hamas stood up and won almost all fronts.... Hamas has managed to turn focus on Gaza, it made it into the centre of the political discussion.” It seems that the most hawkish Israel government ever, has failed to beat either Hamas or the Palestinian spirit. The Palestinians are stronger than ever while the Jewish State has been exposed as an impotent manic-depressive collective driven by a neurotic and impotent leadership.

If Zionism was ever there to counter Jewish diaspora ghetto paralysis, just to ensure that ‘never again’ Jews would be ‘led like lamb to the slaughter’, Netanyahu, Barak and Liebermann have proved in the past week that paralysis is inherent to Jewish political culture. Like all bullies, they are obsessed with power, but when they meet defiance, their vile paradigm instantly collapses.

Speech can provides us with an insight into what we most lack. Speech can reveal that which we prefer to keep hidden. But speech is also often rather misleading, there to shape our lies into a truthful narrative. But it is these ‘true lies’ that provide an access to the fearful-self. It is these ‘true lies’ that reveal the unconscious. So, when, for instance Jewish ‘anti’ Zionists preach to us about Jewish ‘humanism and universalism’ they are obviously lying yet are they not also expressing a yearning for such an ethos to really exist in their own culture? Similarly, when Israel refers to itself as ‘The only democracy in the Middle East’ it this not because Israel would really love to be such a true democracy? In other words, often, when we speak we demonstrate what we most lack i.e. that which we miss and desire, yet we cannot admit this to ourselves. When Netanyahu decided to designate his latest massacre as a Pillar of Cloud, he actually tried to disguise from himself and his people the fact that in reality, he is actually an impotent, and the cloud is actually one big duvet of lies, there only to conceal his shame.

Israel and the Israelis love to talk about their ‘power of deterrence’ - Israeli actions, there to deter Palestinians and Arabs from even contemplating the possibility of challenging the Jewish state. In fact, the entire Israeli foreign and military policy can be realised with reference to that power. Israel likes to see itself at the core of its neighbours’ anxiety. This explains the Israeli fascination with the accumulation of nuclear bombs and other WMDs. It explains the policy towards Iran and it also explains its brutal attitude towards the Palestinians.

Israelis are obsessed with ‘deterrence’ only because, deep down, they are aware of their own vulnerability. Israelis are fanatical about ‘deterrence’ because they know that when push comes to shove, they themselves are actually powerless. They are now exposed for what they are: a fragmented society dominated by egotistic hedonism. Israelis know that their underbelly is very soft indeed.

Israeli collective melancholia must be realised in the light of their inevitable encounter with their true nature. As Ynet admits, they have been defeated in almost every possible respect. As a society, they have been caught naked and their imaginary collective bond has proved to be a farce. In spite of Israel’s mighty, sophisticated army the Hamas leadership, together with the people of Gaza, remained defiant. In spite of relentless air raids, and till the very last moment, Hamas kept firing their rockets reminding Israelis what life in Gaza is really like. When it seemed that the IAF had done its worst (but achieved so little), the Israeli government called on its 75.000 reservists, hoping against hope that such a move would bully Hamas into surrender. Again they were wrong. Ismail Haniah made things very clear when he invited the Israeli reservists to try their luck and enter the strip. Israel was caught with its trousers down – and believe me, the vision of their collective genitalia was not a pretty sight!

‘Unconscious is the discourse of the other’ says Lacan. The fear of impotence is not the fear that you may not be up to much in bed, it is actually the unconscious nightmare that everyone around you is saying behind your back that you’re not up to much in bed. Israelis not just now admitting their impotence to themselves, they are also aware of now being seen as a bunch of arrogant, cowardly and helpless barbarians.

By the time it became clear that the Pillar wasn’t even semi-erect and the Cloud couldn’t cover even that embarrassing truth, Netanyahu, Barak and Liebermann as well as the whole of Israeli society realised that nothing was left of Israel’s power of deterrence - for the Palestinians have lost their fear.

Assuming the ceasefire holds, it is now time to assess the preliminary results of the Israeli attack on Gaza, and I would score this one as a definite victory for Hamas.  Why?

Because it is pretty clear that the IDF was deterred from entering into Gaza whereas the usual orgy of violence unleashed by the Israelis on the Gaza Strip did not deter Palestinians at all.  It is also pretty clear that the Israelis were the ones who wanted a ceasefire whereas Hamas could have kept going, all for the same reason: there was nothing more left worth destroying in Gaza.
 
Bottom line: if anything, that pompous imbecile Netanyahu actually substantially weakened the deterrent capability of the Israeli military with the operation "Pillar of Defense".

Think of it this way: according to Time magazine, as of the 19 of November the IDF had launched more than 1,350 air, tank, and warship strikes against targets in the Gaza Strip (the actual figure will be substantially larger, of course).  And yet, even after such an intensive fire preparation of the battlefield, the IDF did not dare enter Gaza.  This is frankly pathetic and makes me wonder if the IDF is still capable of *any* real military operation (shooting unarmed civilians does not qualify).  This dismal performance is even more pitiful when you consider the rather lame performance of Hamas.

Having promised to open the "Gates of Hell"  Hamas delivered a missile assault which could be compared to the effect of a wet firecracker.  And yet, in all their misfortunes, the Palestinians are blessed to have paranoid cowards like the Israelis as their oppressors: the otherwise totally useless Qasssem missiles are still good enough to scare a population suffering from a form of psychosis Gilad Atzmon calls "pre-traumatic stress disorder".

The real deterrent capability of Hamas lies, of course, not in the Qassem missile, but in its foot soldiers which would have met any Israeli incursion inside Gaza with an intense combination of anti-tank fire, snipers, and highly mobile assault groups.  But the Israelis do not have what it takes for that kind of fight.

Operation "Pillar of Defense" pitted Israeli hardware against Palestinian morale, and that the latter clearly came out on top.

Israel's Leaders on the Run

Senior officials in Israel confirmed reports on Monday that a British court issued a warrant against opposition leader Mrs. Tzipi Livni for her role in orchestrating Israel's military offensive against Hamas in the Gaza Strip last December.

British sources reported that though a British court had issued an arrest warrant for Livni over war crimes committed in Gaza, it annulled it upon discovering she was not in the U.K.

As many of us predicted for more than a while the tide is changing. Now Israeli political and military leaders are finally being chased.

Haaretz reported today that Foreign Secretary David Miliband, the man who last week appointed a Zionist Jew to be the next British Ambassador to Israel, announced today that Britain would “no longer tolerate legal harassment of Israeli officials in this fashion.”

Miliband maintained that “the British law permitting judges to issue arrest warrants against foreign dignitaries without any prior knowledge or advice by a prosecutor must be reviewed and reformed”. I find myself puzzled, why exactly this law is to be ‘reviewed’ or ‘reformed’. Is it because Britain decided to give up on its ethical tradition? Or is it because Miliband needs the support of the Labour Friends of Israel so he can be re-elected. Or is he just revealing an ever-present hidden cronyism?

Miliband said that “the British government was determined that arrest threats against visitors of Livni's stature would not happen again.” And I find myself bewildered again, what does he mean by “Livni’s stature’? Does he really mean that ‘Livni like’ genocidal murderers are now welcome on British soil?

"Israel is a strategic partner and a close friend of the United Kingdom. We are determined to protect and develop these ties," Miliband said. This obviously brings to mind the old saying ‘tell me who your friends are, and I'll tell you who you are’. Considering Labours recent history (aka Illegal wars and foreign invasions) it is far from surprising that Miliband has so many friends in the Jewish state. And not just ordinary Israelis but actually the leading mass murderers.

According to Haaretz, Miliband called Livni to express his shock over the arrest warrant and pledged to address the matter immediately. Years ago, when we were young and naive our lecturers on politics insisted on telling us that judicial independence is crucial to the democratic process. Seemingly this principle is not highly regarded by Miliband who professes to spread democracy around the world. Miliband may benefit from spending some time with my son’s primary school teachers so he grasps what democracy stands for.

Livni clarified that she “doesn't view the arrest warrant as a personal offense, but rather one that affects Israel as a whole.” She is obviously right. The Israeli society is regarded by the growing European masses as a criminal exterminatory state. The arrest warrants against Israeli leaders are indeed just a symbolic act.

Prime Minister Benjamin Netanyahu on Tuesday issued a statement saying "We will not agree to a situation in which Ehud Olmert, Ehud Barak and Tzipi Livni will be summoned to the defendant's bench…We will not agree that IDF commanders and soldiers, who - heroically and in a moral fashion - defended our citizens against a brutal and criminal enemy, will be condemned as war criminals. We reject this absurdity outright." It is pretty obvious where Netanyahu is coming from, yet, the Israeli PM must fail to see that dropping white phosphorous on civilians is not exactly what Europeans and cultured people regard as ‘heroism’ or ‘moral fashion’.

The Israeli Foreign Ministry is almost as amusing as its bigot Minister Avigdor Liberman. In an official statement the Ministry declared "We appreciate the British government's desire to play a central role in the Middle East peace process, and thus we expected it to translate the importance it gives its relations with Israel into actions.” Let’s face it, intimidating is a common Israeli tactic. Yet, the fact that Israelis want us to believe that they are heading towards peace is less than comical, it is downright treacherous. Britain is not going to play a part in the ‘peace process’ because there is no such process.

In response to the warrant, Livni deflecting personal guilt said Tuesday that “she would not accept any accusation that compared Israel Defense Forces soldiers to terrorists.” She is actually correct. The so-called ‘terrorists’ are in fact freedom fighters. Israel on the other hand is a racist expansionist state. Its military forces are engaged in a continuous crime against humanity. Israel is as vicious as Nazi Germany but in practice, it is far worse for it is a ‘democracy’. Its murderous practices are a direct reflection of its peoples wishes expressed in a democratic vote. At the peak of the IDF's brutal Gaza campaign 94% of the Israelis supported the lethal measures against the Palestinian population. Israelis are not terrorists, they are actually the embodiment of terror.

ICC evaluates Israeli war crimes case

Press TV reports: The Palestinian Authority has recognized the jurisdiction of the International Criminal Court to investigate Israeli war crimes in Gaza.

Acting Palestinian Justice Minister Ali Khashan sent a brief letter to the court on Jan. 21, in which he recognized the authority of the world's first permanent war crimes tribunal. The court made the letter public Tuesday, APTN reported.

On Monday, the office of the International Criminal Court, ICC, said that the ICC has begun a "preliminary analysis" of alleged crimes committed by Israelis during the recent offensive in the Gaza Strip.

Prosecutor Luis Moreno-Ocampo told a small group of foreign correspondents in a meeting at the court that he has received 150 separate communications calling for war crimes investigations over the Gaza conflict.

"Ali Khashan gave the letter to my office," said the prosecutor.

"My work now is to analyze if this is in accordance with the law," he said, adding that he would not hastily decide on the issue.

Moreno-Ocampo needs to now determine whether "the Palestinian Authority has the power under international law to recognize the court" -- whether the Palestinians should be considered by the court as having sovereign status.

The use of controversial chemical white phosphorous shells, indiscriminate firing during the offensive in the densely-populated coastal sliver, the shelling of a UN school turned refugee camp, as well as the question as to whether other Israeli military tactics were in breach of humanitarian laws are among the issues Tel Aviv has been charged with.

Human Rights Watch has called for an international investigation into allegations of war crimes by Israel.

The Arab League (AL) also made an appeal to the UN General Assembly last week to "form an international committee to investigate Israeli crimes in the Gaza Strip and to set up a criminal court to try Israeli war criminals."

More than 1330 people, a large number of them civilians, were killed and 5450 others were injured in the Israeli war on Gaza.

Israeli warplanes continue air strikes in southern Gaza Strip despite announcing a ceasefire and allegedly ending the 23-day war.

On Monday, One Palestinian civilian was killed and four others were injured in an Israeli air strike in southern Gaza Strip. On Tuesday, Israeli warplanes attacked the northern Gazan town of Jabaliya.

A SPANISH JUDGE has instituted a judicial inquiry against seven Israeli political and military personalities on suspicion of war crimes and crimes against humanity. The case: the 2002 dropping of a one ton bomb on the home of Hamas leader Salah Shehade. Apart from the intended victim, 14 people, most of them children, were killed.

For those who have forgotten: the then commander of the Israeli Air Force, Dan Halutz, was asked at the time what he feels when he drops a bomb on a residential building. His unforgettable answer: “A slight bump to the wing.” When we in Gush Shalom accused him of a war crime, he demanded that we be put on trial for high treason. He was joined by the Prime Minister, Ariel Sharon, who accused us of wanting to “turn over Israeli army officers to the enemy”. The Attorney General notified us officially that he did not intend to open an investigation against those responsible for the bombing.

I should be happy, therefore, that at long last somebody is ready to put that action to a judicial test (even if he seems to have been thwarted by political pressure.) But I am sorry that this has happened in Spain, not in Israel.

ISRAELI TV VIEWERS have lately been exposed to a bizarre sight: army officers appearing with their faces hidden, as usual for criminals when the court prohibits their identification. Pedophiles, for example, or attackers of old women.

On the orders of the military censors, this applies to all officers, from battalion commanders down, who have been involved in the Gaza war. Since the faces of brigade commanders and above are generally known, the order does not apply to them.

Immediately after the cease-fire, the Minister of Defense, Ehud Barak, promoted a special law that would give unlimited backing by the state to all officers and soldiers who took part in the Gaza war and who might be accused abroad of war crimes. This seems to confirm the Hebrew adage: “On the head of the thief, the hat is burning”.

I DO NOT object to trials abroad. The main thing is that war criminals, like pirates, should be brought to justice. It is not so important where they are caught. (This rule was applied by the State of Israel when it abducted Adolf Eichmann in Argentina and hanged him in Israel for heinous crimes committed outside the territory of Israel and, indeed, before the state even existed.)

But as an Israeli patriot, I would prefer suspected Israeli war criminals to be put on trial in Israel. That is necessary for the country, for all decent officers and soldiers of the Israeli army, for the education of future generations of citizens and soldiers.

There is no need to rely on international law alone. There are Israeli laws against war crimes. Enough to mention the immortal phrase coined by Justice Binyamin Halevy, serving as a military judge, in the trial of the border policemen who were responsible for the 1956 massacre in Kafr Kassem, when dozens of children, women and men were mown down for violating a curfew which they did not even know about.

The judge announced that even in wartime, there are orders over which flies “the black flag of illegality”. These are orders which are “manifestly” illegal – that is to say, orders which every normal person can tell are illegal, without having to consult a lawyer.

War criminals dishonor the army whose uniform they wear – whether they are generals or common soldiers. As a combat soldier on the day the Israeli Defense Army was officially created, I am ashamed of them and demand that they be cast out and be put on trial in Israel.

My list of suspects includes politicians, soldiers, rabbis and lawyers.

THERE IS not the slightest doubt that in the Gaza war, crimes were committed. The question is to what extent and by whom.

Example: the soldiers call on the residents of a house to leave it. A woman and her four children come out, waving white handkerchiefs. It is absolutely clear that they are not armed fighters. A soldier in a near-by tank stands up, points his rifle and shoots them dead at short range. According to testimonies that seem to be beyond doubt, this happened more than once.

Another example: the shelling of the United Nations school full of refugees, from which there was no shooting – as admitted by the army, after the original pretexts were disproved.

These are ”simple” cases. But the spectrum of cases is far wider. A serious judicial investigation has to start right from the top: the politicians and senior officers who decided on the war and confirmed its plans must be investigated about their decisions. In Nuremberg it was laid down that the starting of a war of aggression is a crime.

An objective investigation has to find out whether the decision to start the war was justified, or if there existed another way of stopping the launching of rockets against Israeli territory. Without doubt, no country can or should tolerate the bombing of its towns and villages from beyond the border. But could this be prevented by talking with the Gaza authorities? Was our government’s decision to boycott Hamas, the winner of the democratic Palestinian elections, the real cause of this war? Did the imposition of the blockade on a million and a half Gaza Strip inhabitants contribute to the launching of the Qassams? In brief: were the alternatives considered before it was decided to start a deadly war?

The war plan included a massive attack on the civilian population of the Strip. The real aims of a war can be understood less from the official declarations of its initiators, than from their actions. If in this war some 1300 men, women and children were killed, the great majority of whom were not fighters; if about 5000 people were injured, most of them children; if some 2500 homes were partly or wholly destroyed; if the infrastructure of life was totally demolished – all this clearly could not have happened accidentally. It must have been a part of the war plan.

The things said during the war by politicians and officers make it clear that the plan had at least two aims, which might be considered war crimes: (1) To cause widespread killing and destruction, in order to “fix a price tag”. “to burn into their consciousness”, “to reinforce deterrence”, and most of all – to get the population to rise up against Hamas and overthrow their government. Clearly this affects mainly the civilian population. (2) To avoid casualties to our army at (literally) any price by destroying any building and killing any human being in the area into which our troops were about to move, including destroying homes over the heads of their inhabitants, preventing medical teams from reaching the victims, killing people indiscriminately. In certain cases, inhabitants were warned that they must flee, but this was mainly an alibi-action: there was nowhere to flee to, and often fire was opened on people trying to escape.

An independent court will have to decide whether such a war-plan is in accordance with national and international law, or whether it was ab initio a crime against humanity and a war-crime.

This was a war of a regular army with huge capabilities against a guerrilla force. In such a war, too, not everything is permissible. Arguments like “The Hamas terrorists were hiding within the civilian population” and “They used the population as human shields” may be effective as propaganda but are irrelevant: that is true for every guerrilla war. It must be taken into account when a decision to start such a war is being considered.

In a democratic state, the military takes its orders from the political establishment. Good. But that does not include “manifestly” illegal orders, over which the black flag of illegality is waving. Since the Nuremberg trials, there is no more room for the excuse that “I was only obeying orders”.

Therefore, the personal responsibility of all involved - from the Chief of Staff, the Front Commander and the Division Commander right down to the last soldier - must be examined. From the statements of soldiers one must deduce that many believed that their job was “to kill as many Arabs as possible”. Meaning: no distinction between fighters and non-fighters. That is a completely illegal order, whether given explicitly or by a wink and a nudge. The soldiers understood this to be “the spirit of the commander”.

AMONG THOSE suspected of war crimes, the rabbis have a place of honor.

Those who incite to war crimes and call upon soldiers, directly or indirectly, to commit war crimes may be guilty of a war crime themselves.

When one speaks of “rabbis”, one thinks of old men with long white beards and big hats, who give tongue to venerable wisdom. But the rabbis who accompanied the troops are a very different species.

In the last decades, the state-financed religious educational system has churned out “rabbis” who are more like medieval Christian priests than the Jewish sages of Poland or Morocco. This system indoctrinates its pupils with a violent tribal cult, totally ethnocentric, which sees in the whole of world history nothing but an endless story of Jewish victimhood. This is a religion of a Chosen People, indifferent to others, a religion without compassion for anyone who is not Jewish, which glorifies the God-decreed genocide described in the Biblical book of Joshua.

The products of this education are now the “rabbis” who instruct the religious youths. With their encouragement, a systematic effort has been made to take over the Israeli army from within. Kippa-wearing officers have replaced the Kibbutzniks, who not so long ago were dominant in the army. Many of the lower and middle-ranking officers now belong to this group.

The most outstanding example is the “Chief Army Rabbi”, Colonel Avichai Ronsky, who has declared that his job is to reinforce the “fighting spirit” of the soldiers. He is a man of the extreme right, not far from the spirit of the late Rabbi Meir Kahane, whose party was outlawed in Israel for its fascist ideology. Under the auspices of the army rabbinate, religious-fascist brochures of the ultra-right “rabbis” were distributed to the soldiers.

This material includes political incitement, such as the statement that the Jewish religion prohibits “giving up even one millimeter of Eretz Israel”, that the Palestinians, like the Biblical Philistines (from whom the name Palestine derives), are a foreign people who invaded the country, and that any compromise (such as indicated in the official government program) is a mortal sin. The distribution of political propaganda violates, of course, army law.

The rabbis openly called upon the soldiers to be cruel and merciless towards the Arabs. To treat them mercifully, they stated, is a “terrible, awful immorality”. When such material is distributed to religious soldiers going into war, it is easy to see why things happened the way they did.

THE PLANNERS of this war knew that the shadow of war crimes was hovering over the planned operation. Witness: the Attorney General (whose official title is “Legal Advisor to the Government”) was a partner to the planning. This week the Chief Army Attorney, Colonel Avichai Mandelblut, disclosed that his officers were attached throughout the war to all the commanders, from the Chief of Staff down to the Division Commander.

All this together leads to the inescapable conclusion that the legal advisors bear direct responsibility for the decisions taken and implemented, from the massacre of the civilian police recruits at their graduating ceremony to the shelling of the UN installations. Every attorney who was a partner to the deliberations before an order was given is responsible for its consequences, unless he can prove that he objected to it.

The Chief Army Attorney, who is supposed to give the army professional and objective advice, speaks about “the monstrous enemy” and tries to justify the actions of the army by saying that it was fighting against “an unbridled enemy, who declared that he ‘loves death’ and finds shelter behind the backs of women and children”. Such language is, perhaps, pardonable in a pep-talk of a war-drunk combat commander, like the battalion chief who ordered his soldiers to commit suicide rather than be captured, but totally unacceptable when it comes from the chief legal officer of the army.

WE MUST pursue all the legal processes in Israel and call for an independent investigation and the indictment of suspected perpetrators. We must demand this even if the chances of it happening are slim indeed.

If these efforts fail, nobody will be able to object to trials abroad, either in an international court or in the courts of those nations that respect human rights and international law.

Until then, the black flag will still be waving.

Iranian students offer $1.5m reward for Mubarak execution

The Guardian reports: Radical Iranian students have angered Egypt by offering a $1.5m (£1m) reward for the execution of its president, Hosni Mubarak, after accusing him of failing to oppose Israel's bombardment of Gaza.

The bounty has been put up by the Students' Justice-Seeking movement, which last week staged a sit-in at Tehran's Mehrabad airport demanding to be sent to Gaza as pro-Palestinian volunteers.

The group has labelled Mubarak an "international terrorist" and accuses him of collaborating with Israel by failing to open the Egypt-Gaza frontier at Rafah for humanitarian purposes. It also alleges that the Egyptian government has allowed Israeli planes to use the country's airspace to carry out raids.

Organisers distributed posters showing Mubarak with a fake bullet-hole in his forehead and scissor marks through his neck. The posters carry a proclamation in English offering a "$1,500,000 award for executing Mubarak" and an Arabic message from the Qur'an declaring: "Accursed, they will be seized wherever found and slain with a slaughter."

Iran's foreign ministry has dismissed the offer as not reflecting government policy after Egyptian officials called for its organisers to be prosecuted.

The students responded by increasing the reward from the original $1m sum. Money will be raised, they say, from the distribution of a documentary celebrating the 1981 assassination of Mubarak's predecessor, Anwar Sadat, who was killed by Islamists outraged by his signing the Camp David peace accords with Israel. Some students have also volunteered to sell their kidneys.

The issue threatens to further complicate attempts at restoring Iran-Egypt relations. Tehran severed diplomatic ties after Egypt sheltered the shah when he was toppled in the 1979 Islamic revolution.

Recent efforts to renew links have foundered partly on Egypt's insistence that Iran rename a street in Tehran honouring Sadat's assassin, Khaled Islambouli.

Israel braces for war crime charges

Press TV reports: Israel prepares to respond to possible war crimes charges after its soldiers admitted to having used chemical weapons against Gazans.

Israeli government sources revealed on Friday that Prime Minister Ehud Olmert had tasked an inter-ministerial team to clear Tel Aviv of possible war crimes charges relating to its three-week-long assault on Gaza.

Israeli Justice Minister Daniel Friedman will spearhead the efforts to coordinate a legal defense for civilians and the military amid world condemnation of Tel Aviv's war on Gaza.

Israel moved close to being prosecuted for war crimes after Norwegian found traces of depleted uranium in Gaza victims, suggesting that Israel used the illegal weapons in its war on the densely-populated territory.

The UN nuclear watchdog said on Wednesday that it would open an investigation into Israel's alleged use of depleted uranium weapons, which are listed as 'illegal weapons of mass destruction' in the Geneva Convention.

The case for Israeli war crimes became stronger on Thursday when the Israeli military admitted that it pounded the Palestinian coast with at least twenty phosphorus bombs during the offensive.

White phosphorus, classified as a 'chemical weapon' by the US intelligence, is a highly-incendiary substance that bursts into all-consuming flames that cannot be extinguished with water, burning flesh to the bone and often leading to death.

Under the Geneva Treaty of 1980, the use of white phosphorous as a weapon is prohibited.

Human rights group Amnesty International has also touched on the issue, saying that Tel Aviv used white phosphorus munitions "indiscriminately and illegally" in overcrowded areas of Gaza.

"The repeated use [of White Phosphorus] in this manner, despite evidence of its indiscriminate effects and its toll on civilians, is a war crime," said Donatella Rovera of the Amnesty International.

Eight Israeli human rights groups have also called for an investigation into the offensive -- which has left some 1,340 people dead and thousands of others hospitalized.

UN special rapporteur for the Palestinian territories, Richard Falk, meanwhile, said Thursday that there is more than enough evidence that Israel committed war crimes in the strip.

According to Falk, the crimes committed in Gaza are clearly reminiscent of "the worst kind of international memories of the Warsaw Ghetto", which included the starvation and murder of Polish Jews by Nazi Germany in World War II.

Israel launched its Operation Cast Lead on December 27 to allegedly defend its territories from Hamas rockets, which were fired in retaliation for Israel's defiance of a ceasefire that had previously been in place.

The UN Charter and international law, however, does not give Israel the legal foundation for claiming self-defense in the case of the Gazans.

IDF censor bans naming officers involved in Gaza op

Ha'aretz reports: The Military Censor is applying strict restrictions preventing the media from identifying officers who participated in the Gaza Strip fighting and information about them that may be used in legal proceedings against them abroad. There is growing concern at the Defense Ministry and the Ministry of Justice that Israeli officers will be singled out in a massive wave of suits for alleged human rights violations.

The new instructions from the military censor to the media were prepared in consultation with Attorney General Menachem Mazuz and his military counterpart, Brigadier General Avihai Mandelblit. Chief of Staff Gabi Ashkenazi was also involved in the decisions on this matter.

In recent days the censor has forbidden publishing the full names and photographs of officers from the level of battalion commander down. It is assumed that the identity of brigade commanders has already been made known. The censor also forbids any reports tying a particular officer of such battlefield command rank (lieutenant to lieutenant colonel) to destruction inflicted in a particular area.

There is particular concern at the Defense Ministry that interviews in the press by officers describing the destruction of homes or harm to civilians in areas where they commanded forces could become "self-incriminating" evidence, used by human rights groups and political groups seeking to bring suits against IDF officers.

The new regulations were finalized earlier this week, tightening censorship rules that had allowed more detailed reporting, as well as revealing the identities of officers. Two days ago, an unofficial report was received on a suit allegedly brought in the Netherlands against the commander of one of the brigades, following the release of his identity to the media. Israel's ambassador to the Netherlands has been unable to confirm that such a suit had been filed.

Moreover, it is known that a number of organizations have begun preparing a "target list" of officers - names of officers involved in the fighting and where they fought, in an effort to establish evidence that will allow legal proceedings to begin.

The commander of the Gaza Division, Brigadier Eyal Eisenberg, when asked Thursday whether he was concerned that legal steps would be taken against him and his officers abroad, said that "the state is supposed to provide security to its citizens. The operation [in Gaza] came after eight years of suffering thousands of Qassam rockets in the Negev. I think we embarked on a just war and I stand behind the troops."

Bring justice to the Israeli criminals, today!

Gilad Atzmon is unique in his stance, unprecedented in his voice and unequivocal in his statements. As an Israel-born jazz musician and anti-Zionist activist, he propagates and chants his anti-Israeli contemplations explicitly and once he finds the opportunity.

As a musician who plays soprano, tenor and baritone saxophones, clarinet, sol, zurna and flute, Atzmon has won several international awards so far, including the BBC Jazz Award 2003, and is considered as one of the most prosperous artists of his rank.

In the position of an anti-Zionist activist, despite being Israeli originally, Gilad Atzmon incessantly denounces his belonging to the Jewish state and proclaims that he merely was born there and no more, which was perceptibly out of his knack and election, and that he feels no sympathy, compassion or nostalgia toward the occupying state of Israel.

During the past years, he has written a stack of articles and given a batch of lectures, performs regularly to condemn the historical belligerence of Israel in the occupied territories of Palestine and currently is lobbying dynamically by traveling to different countries so as to augment the cognition of public opinions about the massacre of Gaza and the butchery of innocent civilians, children and women in the strip.

In his recent trip to Greece, which he departed for a few days ago, Atzmon conducted quite a lot of interviews and appeared on a number of TV, Radio programs so as to express his sharp censure of Israeli genocides in Gaza. He believes that the people of Greece are hopefully much more knowledgeable, well-informed and that's why they have made great efforts to convey their sympathy and patronage to the people in Gaza.

Following is the full text of an exclusive interview with Gilad Atzmon in which a variety of topics related to the ongoing slaughter of Gaza, Israeli crimes against humanity and the necessity of holding a trial for the Israeli officials in a just and objective international court is discussed:

Kourosh Ziabari: First, I would like to ask your opinion about the ongoing conflict of Gaza which some named "the most catastrophic battle" in the last decade. What's your idea about the carnage of civilians, children, women and infants in Gaza?

Gilad Atzmon: What we see in Gaza is holocaust denial in its making. The Jewish state exercises hardcore barbarism. Yet, the world keeps silent. Once again we are confronted with the realization that giving a mandate for a national home for the Jewish people has been demonstrated to be a grave lethal mistake. The only question is how to dismantle this monstrous suicidal hawkish creature without turning our planet into a fireball.

Kourosh Ziabari: You criticize the Israeli state so sharply; nevertheless, you may have noted that the Israeli media and statesmen simply stick a label of "traitor" to each of the Israeli citizens, journalists, professors or rhetoricians who uses to blame the Jewish state for its butcheries and onslaughts. How do you solve this?

Gilad Atzmon: To start with, it is not such a bad thing to be a ‘traitor’ in a murderous state. However, I do not regard myself as an Israeli. I was born there but I haven’t lived or visited there for many years. Once I realized that I was residing on stolen land as an oppressor I packed my saxes and left. To a certain extent, I can be regarded as a 'proud self hating Jew'. I am full of shame of myself and those who were my co-nationals. I talk about my shame; I write about it and compose music trying to deal with it.

Kourosh Ziabari: Israeli officials claim that they are just seeking retaliation by attacking the bases of Hamas, merely killing the individuals of army and military. In the other side, they disallow the entrance of journalists and media correspondents into the occupied Gaza Strip and ban them from broadcasting the reality. How can they justify this contradiction? Why they don't allow the journalists into Gaza if they are righteous about their pretensions?

Gilad Atzmon: I do not think that Israelis are concerned at all with contradictions or logical discrepancies. Israelis are not concerned at all with their image either.

I will try to elaborate. Israel is now the largest Jewish Ghetto ever. The Jewish Ghetto is basically a place where Jews can celebrate their symptoms collectively among themselves, without being shy about what they say, think or feel. Israel has already surrounded itself with gigantic walls just to give segregation a real significant meaning. And yet, the Israeli Jewish Ghetto is very different from the East European one. While in the European Ghetto the Jews were intimidated by their surrounding reality, in the Israeli Ghetto the Jews intimidate others. They insist that the entire Middle East must be kept in a state of constant anxiety.

The Ghetto mentality is a very helpful analytic tool. It helps us, for instance, to grasp why Prime Minister Olmert allowed himself to brag in public about humiliating President Bush and Secretary of State Rice. In the Ghetto Jews feel safe, they can speak their mind while being pretty sure that nothing would leak out to the Goyim. In the Ghetto only one logic applies, the Jewish logic.

However, in the 1950’s PM Ben Gurion adopted the Jewish Ghetto framework into an Israeli political mantra which he eloquently articulated as follows: "It doesn't matter what the Goyim say, the only thing that matters is what the Jews do". Seemingly, the Jewish Ghetto mantra à la Ben Gurion succeeded in separating the Israelis from the rest of humanity. But it goes further, as we see in Gaza and in any Israeli conflict; it detaches the Hebraic paradigm from any notion of humanist ethics.

This very philosophy is translated easily into Israeli lethal military pragmatism. ‘It obviously doesn't really matter what the UN or world’s media thinks, all that matters is what the IDF does’.

Now, I will try to address the foreign Journalist topic. Israeli military leaders knew in advance that Gaza was about to become a bloodbath for Palestinian civilians. They obviously knew in advance the weaponry they were about to employ. The last thing they needed was foreign journalists reporting to their media outlets about a massacre in Gaza. World media and the ‘right to know’ is not an Israeli interest. In the Jewish Ghetto state, all that matters is what the IDF is doing.

The Israelis wanted to finish their job first, to kill many Palestinians, to destroy Gaza and to dismantle its infrastructure so they retrieve their power of deterrence which they have lost many years ago. Journalists reporting from Gaza could simply stand in the way.

Kourosh Ziabari: given such an intricate description, what's the main reason, in your view, for Israel blocking the humanitarian aid ships heading to Gaza? Is there something wrong with the admittance of foods, medicine and first aid to a multitude of people who do not have the least access to the outside world?

Gilad Atzmon: The answer is almost etymological. Talking about ‘Humanitarian effort’ presumes a deep familiarity with the notion of humanism. Since Israelis have zero commitment to ethics or universal humanism, we cannot expect them to succumb to any humanitarian effort or humanist issue. In the last few days, Israel bombarded hospitals, schools, refugee centers and UN aid distribution centers. We better admit it: the Jewish state is a boiling criminal setting with no comparison. We cannot and should not expect them to follow a humanist call. We should instead anticipate Israel to perform as embodiment of the ultimate evil, and sadly, I must say, they indeed never disappoint here.

Kourosh Ziabari: The employment of white phosphorus in the bombs that the Israeli army unleashes on the heads of civilians and their houses in Gaza seems to be an evident violation of international regulations and the Geneva Convention, significantly. Is there any way of recompensing these war crimes?

Gilad Atzmon: I am not a legal expert so cannot address this question properly. However, it is very interesting to note that in spite of large worldwide condemnation of Israel for using white phosphorus bombs, the Israeli army didn’t stop employing this tactic, and it's not the first time they've used unconventional weapons against civilians in the face of international outrage. Every day we see those lethal bombs bursting over civilian targets. Once again we see that it doesn’t matter at all what the Goyim say, all that matters is what the Jews do, i.e., kill Palestinian civilians. I would further add that the Israelis lament in continuation about "potential" weapons of mass destruction that other nations might have, it seems to be pathetic while possessing an obscene arsenal of nuclear warheads themselves. If they have no regard for international law, why would they care what world opinion is?

Kourosh Ziabari: Provisionally, even if the war ends now and Israel withdraws from the occupied territories, the result of fatal conflict is more than 1300 dead people and 70% of the infrastructure, buildings, public places has been destroyed. How the real justice could be administered about Israel and its crimes against humanity?

Gilad Atzmon: Again, I am not a legal expert. Yet I do not hold my breath. However, my subject of study is Jewish and Israeli identity. I am interested in the metaphysics of the Israeli genocidal inclination. I am elaborating on the Identity that can inflict so much pain and carnage on innocent civilians. I am interested in the banality of evil as exposed by Israel’s ultimate barbarism and the Jewish institutional support of that evil around the world. I believe that once we start to realize what we are up against, we may know how to fight it. I honestly do not believe in international tribunals. A general widely accepted acknowledgment that the Jewish state is nothing but crude barbarism seems to me far more effective.

Kourosh Ziabari: For the last question, what's your message, as an Israeli artist, to the people of Palestine; those mothers who have lost their children or those traumatized children who undergo the aftershocks of losing their parents?

Gilad Atzmon: My Dearest brothers and sisters. It is heartbreaking to watch the death and carnage inflicted on you by the Jewish state. We all see what you are going through and we all know that justice is on your side. I beg you not to lose hope. Evil always comes to an end and Israeli evil is no different. Israel will come to an end though we may have to do something to bring this end about.

However, one thing is rather clear. The so called ‘liberal’ west failed to save you, sadly enough; the Arab states failed to join your struggle yet. As sad as it may be, as much as justice is on your side, you are alone here confronted with the ultimate evil.

Israel has many bombs in its arsenal. But you Palestinian brothers and sisters have a few things they do not have: Justice is in your side, humanity is in your streets, you have the spirit and you have the ultimate bomb, namely the demographic one.

Hamas to Fight On if Israel Ceases Fire Unilaterally

Al-Manar reports: This unilateral ceasefire does not foresee a withdrawal" by the Israeli army,” Hamas’s representative in Lebanon Oussama Hamdan said Saturday. He stressed the resistance group will fight on if Israel orders a unilateral ceasefire in Gaza. "As long as it remains in Gaza, resistance and confrontation will continue," he said.

Speaking at a conference in Beirut, also attended by European representatives supporting the Palestinians, Hamdan added that Israel's proposal for a unilateral ceasefire, which was to be put to a vote of the security cabinet later on Saturday, was an "attempt to derail the Egyptian plan" for a reciprocal truce. “The different initiatives for a ceasefire were aimed at getting the Palestinians to concede things "which the enemy failed to achieve through the fighting,” he said.

Hamas would only agree to a ceasefire if the conditions set by the organization are met. "I would like to suggest to all the mediators to focus in their initiatives on halting the offensive and lifting the blockade and not to touch anything else."

He called on regional elements to stand by the resistance and warned Israel that “if we don't hear what we want, we'll return to the fighting arena."

'Don't suggest that we surrender because we haven't been defeated and we won't be defeated. Our determination grows stronger every day, because our debt to the martyrs whose blood has been spilled is bigger. We shall continue fighting, so don't suggest that we surrender,” Hamdan stressed.

The senior Hamas official called on the Palestinian people to continue the struggle and addressed resistance fighters in Gaza.

"Just like the resistance was victorious in Lebanon in 2006, you will win in January 2009."

"There are elements in the region which believe that the enemy treats them as a partner. They don’t understand that the enemy treats them like servants or like an improved image of the ancient slaves, but this is the 21st century," he said signaling several leaders dubbed by the US as so called ‘moderate Arabs.’

He also criticized Mahmoud Abbas, whose term as PA leader ended in January 9, for not showing up at the Arab summit in Qatar.

Hamdan stressed that Israel's leaders should be put on trial for committing war crimes in the Gaza Strip. He told the Europeans that "the Zionist entity enjoys a special status in the European Union."

He also congratulated the presidents of Venezuela and Bolivia for severing their diplomatic ties with Israel, and ridiculed Arab leaders who he said were letting Israel act without disturbances.

Ismail Haniyeh: My message to the West – Israel must stop the slaughter

I write this article to Western readers across the social and political spectrum as the Israeli war machine continues to massacre my people in Gaza. To date, almost 1,000 have been killed, nearly half of whom are women and children. Last week's bombing of the UNRWA (UN Relief Works Agency) school in the Jabalya refugee camp was one of the most despicable crimes imaginable, as hundreds of civilians had abandoned their homes and sought refuge with the international agency only to be mercilessly shelled and bombed by Israel. Forty-six children and women were killed in that heinous attack while scores were injured.

Evidently, Israel's withdrawal from the Gaza Strip in 2005 did not end its occupation nor, as a result, its international obligations as an occupying power. It continued to control and dominate our borders by land, sea and air. Indeed the UN has confirmed that between 2005 and 2008, the Israeli army killed nearly 1,250 Palestinians in Gaza, including 222 children. For most of that period the border crossings have remained effectively closed, with only limited quantities of food, industrial fuel, animal feed and a few other essential items, allowed in.

Despite its frantic efforts to conceal it, the root cause of Israel's criminal war on Gaza is the elections of January 2006, which saw Hamas win by a substantial majority. What occurred next was that Israel alongside the United States and the European Union joined forces in an attempt to quash the democratic will of the Palestinian people. They set about reversing the decision first by obstructing the formation of a national unity government and then by making a living hell for the Palestinian people through economic strangulation. The abject failure of all these machinations finally led to this vicious war. Israel's objective is to silence all voices that express the will of the Palestinian; thereafter it would impose its own terms for a final settlement depriving us of our land, our right to Jerusalem as the rightful capital of our future state and the Palestinian refugees' right to return to their homes.

Ultimately, the comprehensive siege on Gaza, which manifestly violated the Fourth Geneva Convention, prohibited the most basic medical supplies to our hospitals. It disallowed the delivery of fuel and supply of electricity to our population. And on top of all of this inhumanity, it denied them food and the freedom of movement, even to seek treatment. This led to the avoidable death of hundreds of patients and the spiralling rise of malnutrition among our children.

Palestinians are appalled that the members of the European Union do not view this obscene siege as a form of aggression. Despite the overwhelming evidence, they shamelessly assert that Hamas brought this catastrophe upon the Palestinian people because it did not renew the truce. Yet we ask, did Israel honour the terms of the ceasefire mediated by Egypt in June? It did not. The agreement stipulated a lifting of the siege and an end to attacks in the West Bank and the Gaza Strip. Despite our full compliance, the Israelis persisted in murdering Palestinians in Gaza as well as the West Bank during what became known as the year of the Annapolis peace.

None of the atrocities committed against our schools, universities, mosques, ministries and civil infra-structure would deter us in the pursuit of our national rights. Undoubtedly, Israel could demolish every building in the Gaza Strip but it would never shatter our determination or steadfastness to live in dignity on our land. Surely, if the gathering of civilians in a building only to then bomb it or the use of phosphorous bombs and missiles are not war crimes, then what is? How many more international treaties and conventions must Zionist Israel breach before it is held accountable? There is not a capital in the world today where free and decent people are not outraged by this brutal oppression. Neither Palestine nor the world would be the same after these crimes.

There is only one way forward and no other. Our condition for a new ceasefire is clear and simple. Israel must end its criminal war and slaughter of our people, lift completely and unconditionally its illegal siege of the Gaza Strip, open all our border crossings and completely withdraw from Gaza. After this we would consider future options. Ultimately, the Palestinians are a people struggling for freedom from occupation and the establishment of an independent state with Jerusalem as its capital and the return of refugees to their villages from which they were expelled. Whatever the cost, the continuation of Israel's massacres will neither break our will nor our aspiration for freedom and independence.

Gilad Atzmon - Israel Has Managed to Lose Again

Haaretz reported today that IDF Senior officials "believe that Israel should strive to reach an immediate cease-fire with Hamas, and not expand its offensive against the Palestinian Islamist group in Gaza."

This shouldn't take us by great surprise. Though Israel has proved beyond doubt that it is rather capable of conducting large-scale genocide, it also proved that its military forces do not have the answer to Islamic resistance. The Israeli chief military officials admitted as well that "Israel achieved several days ago all that it possibly could in Gaza." The IDF, so it seems, finished its role in Gaza. It turned its neighbourhoods into piles of rubble. Relentlessly, it even murdered the civilian population in broad daylight by means of air raids and attacks from warships. Images of white phosphorus artillery shells bursting over schools and hospitals are now part of our collective memory. Tanks firing into schools loaded with evacuees seeking refuge from the bombing of their buildings is now the image associated with the Hebraic soldier and yet, the Israelis failed to achieve any of their objectives. I must admit that it must take a special talent to be an Israeli general. As much as they are good in committing war crimes, they somehow fail in everything else.

The Israeli politicians initially swore to destroy Hamas, they then lowered their expectations, they promised just to destroy Hamas' rocket launching capabilities, all the while reassuring their excited Israeli voters that this time the Jewish State will fight till the bitter end. Seemingly, their promises fell too short once again.

Hamas is still there; its support within the Palestinian street is stronger than ever. But it is not only the Palestinian street. Hamas' message of defiance is spreading all over the Muslim world and beyond. Last week I was marching in London together with another 100,000 protesters. The support for Hamas was all around. It was on placards, flags, headbands and loudspeakers. Not only is Hamas far from being defeated, its rocket launching capability seems to be unaffected. Day after day Hamas combatants manage to remind Israelis in Ashdod, Ashkelon and Sderot that they actually live on stolen Palestinian land. Give Hamas the necessary time and the ballistic message will be carried to every corner of stolen Palestine.

Israel is desperate for an exit strategy. I learned today that Defence Minister Barak is looking for a week long humanitarian ceasefire. Please do not hold your breath, the notorious mass murderer didn't change his spots all of a sudden. Being a veteran general, Barak realises very well that his soldiers on the ground need a break and they need it now. Being that they are gathered together in a few scattered open areas, they are currently exposed to Hamas' snipers and mortar fire. In the last few days, Israeli forces started to suffer a growing number of causalities. The attempt to step up the battle into Gaza's neighbourhood met with some severe resistance. The Israeli army is stuck once again.

If this is not enough, within a few days Obama is going to reside in the White House and the Israelis are not totally convinced that the new American president will blindly support their murderous strategy. Defence Minister Barak realizes that his window of opportunity might be closing down. He realises that IDF soldiers may have to dig in Gaza city outskirts without achieving any of the war's military objectives. Barak needs a few days of ceasefire to create a new reality on the ground. He obviously prefers to hide behind a humanitarian effort. This is far easier than admitting that once again the IDF was caught unprepared. Olmert aids, however were stupid enough to admit the lie. Apparently one of them slammed Barak earlier on today suggesting that "Hamas sees the scenes and hears the voices, these comments are a shot in the arm for Hamas and its leaders."

As things stand, IDF soldiers are now stranded in Gaza. Don't misinterpret me, they are still capable of spreading death and inflicting carnage, yet they cannot win this war. The IAF ran out of ˜military" targets a week ago and the artillery is probably facing the same situation. As news floods in it becomes evident that once Israeli soldiers leave their armoured vehicles and Merkava tanks they are subject to the mercy of Hamas. I have read today on Ynet that some IDF soldiers reported that they "don't really see the enemy", "we get hit and we do not know by who and how."

As things stand, Hamas is becoming a symbol of heroic persistence. Its combatants on the ground fight almost with bare hands against America's most lethal technology. Similarly, Hamas'political leadership has managed to set itself as the key to any possible resolution of the current conflict. The hope that Hamas would be toppled or discredited proved to be just another Jewish wet dream. Hamas is now becoming a widely accepted entity by the international community. It is regarded as an elementary ingredient in any possible solution. Israel, on the other hand, is seen for what it is for real, a murderous criminal state involved in genocidal war crimes of the worst order.

However, there is a new reality that we have to bear in mind. The damage Israel is leaving behind in Gaza is horrific. It has flattened neighbourhoods, it has spread white phosphorus in populated areas. As if this is not enough, the many tons of bunker buster bombs which Israel was using day and night have shaken the foundations of every building in Gaza and the question looms large as to whether Gazan houses that are still standing will be safe to live in. EU officials raised the question today wondering who is going to pay for the reconstruction of these eradicated towns, camps and villages.

In an ideal ethical world, Israel would have let the Gazans go back to their land. But ethics and Israel are very much like parallel lines. They somehow never meet. As much as it is clear that Palestinians will come back to their land, it won't be Israel that that will welcome the inevitable returning Palestinians.

Someone will have to rebuild Gaza, and the only name that comes to mind is the democratically elected Hamas. Such a huge project maintained by Hamas will be the right answer to Israel's criminal war and its murderous objectives.

IDF targets hospital, UN compound and journalists

Ha'aretz reports: The Al-Quds hospital in Gaza City was engulfed in flames on Thursday after it was caught in the fighting between Israel Defense Forces troops and Hamas.

Just before, the IDF shelled the main United Nation aid compound in the city of Gaza, drawing harsh criticism from visiting UN Secretary General Ban Ki-Moon and a subsequent apology from Defense Minister Ehud Barak. The United Nations Relief and Works Agency (UNRWA) said its compound, where up to 700 Palestinians were being sheltered, was hit twice by fire and three staff members were wounded.

Another explosion blasted a tower block that houses the offices of Reuters and several other media organisations, wounding a journalist for the Abu Dhabi television channel (...)

ICC overlooks Israel's war crimes allegation

Press TV reports: The International Criminal Court prosecutor says it lacks jurisdiction to investigate possible Israeli war crimes committed in Gaza.

The ICC prosecutor said in a statement Wednesday that the "court's jurisdiction is limited to war crimes, crimes against humanity and the crime of genocide committed on the territory of, or by a national of, a state party while Israel is not a member state.

Tel Aviv launched Operation Cast Lead on December 27 to put an end to rocket attacks against southern Israeli towns. At least 1,015 Palestinians have died during the offensive, while some 4,700 others are reported wounded.

Hamas, the democratically-elected ruler of the coastal sliver, demands a cessation of an 18-month Israeli blockade on the Gaza Strip before its fighters suspend the rocket attacks.

The huge number of civilian casualties in the densely-populated coastal sliver has provoked widespread outcries around the globe among many nations as well as their leaders.

A fierce controversy has also broken out over the alleged use of white phosphorus, also known by the military as WP or Willie Pete, by the Israeli army in Gaza.

Human Rights Watch says its researchers have observed the use of WP -- which causes horrific burns, severe injuries or death when it comes in contact with human skin -- by the Israeli military in the Gaza Strip.

The legality of the toxic chemical agent is a matter of debate, with many groups recognizing it as an illegal weapon, while international law allows its usage solely for smoke-screening.

The US intelligence has classified WP as a "chemical weapon."

There are also reports that Tel Aviv has used depleted uranium against civilians in Gaza.

The International body in The Hague made the remarks Wednesday after a Palestinian rights group called on the ICC to investigate Israel for committing war crimes in Gaza, Reuters reported.

"In Gaza at present, the ICC lacks such jurisdiction," Nicola Fletcher, a spokeswoman for the ICC prosecutor, said adding that the ICC can investigate Israel's war crimes only if Tel Aviv voluntarily accepted the court's jurisdiction, or if it is referred to the court by the United Nations Security Council.

Israel and the United States are not among the 108 signatories of the Rome Statute creating the Hague-based court in 2000 to investigate and prosecute war crimes.

'Full Red Alert': Hezbollah Ponders Gaza Role

“Where is my friend Hussein?,” this observer asked some of the guys yesterday at my favorite motorcycle repair shop in Dahiyeh, the Hezbollah area in Beirut, as I helped, with my bandaged arm, off load my motorbike. “Silver”, sad to report, was not at all in good shape. In fact Silver needed a front end alignment, a new headlight, two turn signals, a new tail light and a new front wheel guard and at least the cracked windshield taped, before we could head off again and add the more than 11,000 miles we have logged crisscrossing Lebanon together.

The problem was Beirut’s flash hailstorm on Sunday. Immediately upon entering Verdun street near the Dunes hotel, Silver, not being used to a surface road mixture of oil and ice, and having a van cut him off from the right, tried to maneuver and skidded on his side and this observer went tumbling (again!). This time against a hotel protective barrier as some army guys jumped out of the way then courteously helped me up with a friendly “Welcome in Lebanon.”

“Isn’t this about your third ‘divine accident’ this year?,” one of Hussein’s mechanics, Ali grinned, as payback for me telling him a Sunni joke the other day about Hezbollah’s string of “divine victories.”

Again, I asked why my friend Hussein was absent. No response.

If one wants his motorcycle fixed cheap, well and quickly, even the pro government-anti Hezbollah Sunni repair shops in the central Beirut area of Hamra neighborhoods will tell you it’s best to take it to Ghouberi. “Ghouberi” is code language for the Hezbollah area of Dahiyeh/Haret Hareik, where most macho Hamra guys fear to tread as they continue to smart over “the events of May,” when Shia Hezbollah and some of their allies in Shia Amal and the Christian National Syria Socialist Party stormed parts of Sunni West Beirut and locked it down tight for around 72 hours before handing it over to the Lebanese Army. It was all about sending a message to the US-Israeli backed government not to mess with Hezbollah’s communication system or with their guys at the Beirut airport.

Once again the Hezbollah shop that took care of Silver did a great job. The mechanics, mainly Hezbollah reservists with ‘day jobs,’ apply the same work ethic of thoroughness and skill to their bike work as they do defending Lebanon against Israeli attacks. Space only allows for one example. As I inquired about the prospects that Hezbollah would open a second front, I noticed that a mechanic and his Palestinian dropout helper (quitting school is the growing pattern these days in Lebanon’s Refugee camps due to economic and political pressure), one with a screwdriver and the other with a wrench, literally checked and tightened every nut or screw on the bike. Never in 20+ years of riding and crashing motorcycles in more than a dozen countries had I seen mechanics do that.

Pastries or Pistachios as Clues

“So where was Hussein?” I asked for the third time. “He not in Beirut,” one of the mechanics said.

I immediately understood.

There is quite a lot of code language used in Lebanon these days, and “He’s not in Beirut” in Hezbollah parlance means, “He’s been called up,” he’s off somewhere for a few weeks doing ‘training’ or he’s been posted with his 5-6 man unit.

While Hussein is “not in Beirut.” it’s likely no one among his family or friends will hear from him. He may spend days or weeks in a tree along the Blue Line electronically eavesdropping on Israeli soldiers or recording their movements and habits or any one of hundreds of preparatory tasks. Hussein will return as if he just completed his day off but will answer no questions that begin with where, what, why, who, when, are, can, do, etc. Quite likely he will look leaner, stronger, more serious than when he left and will parry inquires with a smile and a question about “what’s new with you,” etc.

One might gain some inkling where he has been from what he brings back as gifts for his pals. For example, if Hussein brings special pastries acquired only from a certain village, which he did last time for this observer, obviously he had been posted in the Bekaa Valley. If he returns with a bag of oranges perhaps he was down south. Iranian candies or Iran’s famous Pistachios? For sure he was, well, the dear reader gets the idea.

Today, the Lebanese Resistance led by Hezbollah remains on full alert, in the 1/10/09 words of Lebanon’s Oppositions leader in Parliament, Mohammad Raad, “in case Israel does something stupid, we are ready.”

Some Hezbollah officials took note of what might be an Israeli record of some sort. They pointed out that whereas in the July 2006 War, Israel killed approximately 1,100 Lebanese civilians in 33 days of carpet, frenzied and indiscriminate bombing, in Gaza they have achieved the killing of approximately the same number of Palestinians, is about have the number of days. No doubt some kind of a lesson the Israeli military learned from their failure in the earlier conflict.

Many questions are being asked throughout Lebanon about whether the Hezbollah leadership will yield to growing pressure from all parts of Lebanon and within its ranks to force Israel to lift its destruction of Gaza? If so, are there ways it could be done without a igniting a sixth war in Lebanon?

Contemporary Wisdom in Lebanon

Every day brings more questions from Resistance observers inside and outside of Lebanon: when is Hezbollah going to deliver on all those speeches by Party leaders expressing Hezbollah’s ‘sacred commitment’ to the bloodstream issue for all Arabs and Muslims: the liberation of Palestine?

These days the Lebanese Resistance, led by Hezbollah is on Full Red Alert and there is a palpable sense of foreboding in many Hezbollah supporting neighborhoods.

In the bike shop, with its “town meeting” atmosphere, some Hezbollah members are more explicit.

“We can hit Dimona with hundreds of rockets on the first day, if we get the order,” the veteran Abass explains. “The Zionists are very lucky I do not have the authority or we would have joined the battle when the first bomb fell on Gaza. It is just a matter of when, not if, we join the Gazan Resisters.”

The largest of dozens of demonstrations in support of the Gaza Resistance Hamas have been organized by Hezbollah. Thousands of those in attendance at every demonstration bristle with anger along with hundreds of millions all over the World. In Lebanon, many, not only in the Palestinian camps and Hezbollah areas, but north and south ache to do something to help the trapped and dying Gazans.

Regarding the likelihood that Hezbollah will come to the military aid of Gaza, the local conventional wisdom, much of it likely wrong, includes:

* Hezbollah is still regrouping its base from the July 2006 Israeli aggression and rebuilding thousands of homes and businesses and doesn’t want them destroyed again.

* Hezbollah may not yet be prepared militarily.

* Hezbollah has not completed its redeployment to the Bekaa Valley and to the strategic mountain tops where the next war with Israel will be largely based. This includes towns such as Sajad near Al-Rihan Mountain, north of the Litani River with its clear view of all of South Lebanon and the upper Galilee of occupied Palestine, as well as part of the Golan and the Mediterranean coastline. The geographic location of Sajad between the Al-Zahrani and Litani Rivers give it strategic importance and links the South and the Bekaa. They need more time.

* The certain massive destruction of Lebanon’s infrastructure of roads, bridges, schools, would turn the populace against it and undermine its great political progress since 2006.

* That Hezbollah, having recently consolidated its base and formed a political coalition with Christian and some Druze leaders wants time to see its alliances grow stronger and free of potential military and political “unintended results.”

* Hezbollah wants to win the currently scheduled June 9, 2009 elections, and being seen as sparking another massive destruction of Lebanon would give its rival parties plenty to beat it over the head with at the polls. Every time Israel issues a new threat against Lebanon and announces in advance that it intends to commit war crimes by destroying Lebanon, this helps Hezbollah’s rivals in the polls as they take to the airwaves and argue that Hezbollah wants another war and does not care about destroying Lebanon like last time. Or, as scholar Amal Saad-Ghorayeb observed last week, intense domestic pressures to disarm, and possible, more externally manufactured, locally-executed conspiracies hatched against it that could drag it into the kind of civil warfare that the movement found itself in during May 2008.

* Hezbollah does not want to risk losing the June 9 election and wants to keep its lead in the polls.

* Hezbollah is currently behind in the polls and needs peace in Lebanon in order to convince swing voters that it will be behave responsibly if the voters will allow it to govern.

* Hamas is assured of winning the war Gaza, given that Israel must win with its 1000 to 1 military advantage or it will be humiliated and, as Anthony Cordesman has pointed out, would likely in any case lose its deterrence position, likely for good.

* That the Israeli government and its supporters claim that Israel learned from their poor performance in July 2006 is wishful thinking and their performance to date strongly suggests Israel has learned nothing and will deliver to Hamas a silver platter with huge organizational and political gifts.

The “Varsity Squad” of Hezbollah has so trained the “Junior Varsity Squad” that there is no need to intervene unless Hamas is on the verge of total elimination which given its strong showing during the past 17 days appears very unlikely. As one Hezbollah reservist noted, “If Hamas survives to fire even one rocket into Israel after Israeli forces eventually withdraw from Gaza, the World will declare Hamas the winner.” Israel discovered Hezbollah expertise last weekend when it learned that the capabilities of Hamas are much more than they anticipated including its ability to strike Beer Sheba.

Based on conversations with several Hezbollah functionaries, Shia Hezbollah appears to have increasingly deep respect for Sunni Hamas. They share an ideology and a set of strategic goals that transcend their religious difference. Both were created as an alternative to failed Arab nationalist organizations in order to effectively confront the Zionist occupation. Hezbollah has been the primary role model, trainer, and “coach” of a “new” Hamas with apparent dramatic results.

Strategically, the fact that Sunni Hamas and Shia Hezbollah cooperate well, despite differing interpretations of some of the Koran, and the Hadith (sayings of the Prophet Mohammad), leads some observers to believe that this display of Muslim unity dampens the effects of the fiery rhetoric of Egypt’s Mubarak and Jordan’s Abdullah, among others, who regularly raise the chicken-little alarm of an Iranian constructed “Shia crescent.”

Hezbollah’s “Parental Pride” in Hamas

When Hezbollah commander Imad Mughniyeh, was assassinated last February, one of the major projects he had been working on for nearly two years was to teach Hamas the lessons Hezbollah learned during the 22-year Israeli occupation of much of Lebanon as well as the 2006 Israeli aggression against Lebanon. The current conflict in Gaza may indicate how well Hamas learned from “Hajj Radwan,” Moghinyeh’s nom de guerre.

It was Israel that killed Imad. One reason was that he was deeply involved in training Hamas with the Hezbollah model of Resistance. He is known to have been very proud of the Palestinians and stated shortly before his death to Party colleagues: “They (Hamas) are becoming a very good resistance force.” Some in Lebanon refer to Hamas as the JV (Junior Varsity) or “red shirts” as opposed to the Hezbollah “Varsity” or “blue shirts,” and “Hajj Radwan” is the coach of both. In another Report to the Party, he expressed his admiration for their ability reporting that, “they are proving day after day that they are powerful people capable of facing all challenges.”

During Mughinyeh’s scores of tutorials, Israel was tipped off by certain Palestinians who had met with Imad and who knew or suspected his real identity from “the old days” when Imad spent years with the PLO and was close to Arafat and his inner circle. Most people, even those who worked closely with him, did not know his true identity and he tried to keep it that way even avoiding his home village where half the residents are Mughinyehs. Yet, some who met with him remembered him and ultimately betrayed him.

Some, including this observer, theorize this is why Mughinyeh was killed, almost certainly with the help of Syrians in Israel’s employ since every individual allowed in the Damascus “special security zone” where the killing occurred was closely vetted, examined and then carefully watched. A “full report” on the assassination was claimed to have been made by the Syrian government, which promised to release it within a few days. In two weeks the report will be exactly one year past the promised release date and no one claims to have seen it.

Yet Hajj Radwan is said to have helped revamp Hamas’ military command and replaced certain elements. One subject Mughinyeh is said to have stressed to Hamas during such meetings was the importance of “the communications network as a strategic weapon,” which included Hamas keeping in direct battlefield contact with other Resistance groups fighting Israel, and advising Hamas on ways of fighting Israel using a number of different tactics and bases in locations in Syria, Lebanon and Iran, according to the authoritative Beirut daily Al Akbar.

One of his communications to superiors in Hezbollah is said to have reported: “The way the bottom of the earth was transformed in (areas) around the Strip and inside cities indicates that if determination and leadership was provided to them (the Palestinians), they would achieve what hasn’t been achieved before.”

Other lessons Mughinyeh offered Hamas, based on the lessons from 2006, included that each Hamas small unit of approximately five fighters should be fully equipped and must have a clear plan to fight Israeli soldiers and to wage a long war of attrition until Israel withdraws. Another included instruction on ways to stockpile weapons that would allow Hamas to have quick access to them even if Israel occupied many areas in the Gaza Strip. It is some of these pre-positioned weapons that special Israeli search units try to find in order to exhibit them for propaganda purposes.

How well Hamas has learned from Hezbollah’s experience remains to be seen. Meanwhile plenty of suspicions and speculation remain concerning exactly who killed Hezbollah’s much loved Imad Mughinyeh and why.

As Hezbollah has leveraged its 2006 victory, Hamas will likely do the same, with the losers again being the American–Israel axis, the current PA leadership, Egypt, Jordan and Saudi Arabia. The winners, in addition to Hamas, are once more Hezbollah, Syria and Iran. Never in American history has one US administration delivered such a long and consistent string of political victories to its declared adversaries while assuring the eventual collapse of its most favored nation, and managing to turn most of the World, and its own country, against itself.
